Leave rules for Central and State Government employees – A comparison

Here is a ready reckoner for all types of leaves for the Central Government and State Government employees. A comparison of different types of leaves useful for employees.

Hyderabad: Both the Central and State Governments issue numerous beneficial orders for the welfare of their employees. Leave rules for employees are a significant part of these orders. When we examine the leave rules of the Central Government and compare them with those of our State Government, we observe similarities in many types of leave, but differences emerge in certain leave categories.

Let’s explore these differences:
Earned Leave (for Vacation Department Employees):
*Central Government: Central Government employees working in Vacation Departments are credited with ten days of Earned Leave annually.
*State Government: Employees of our State Government, when working in Vacation Departments, are credited with only six days of Earned Leave per year.

Conversion of Joining Time into Earned Leave:
*Central Government: Central Government employees can convert any remaining Joining Time into Earned Leave. This converted time is credited to their leave account, with a maximum limit of 15 days that can be converted to Earned Leave in this manner.
*State Government: This facility is not available to employees of our State Government. They cannot convert remaining Joining Time into Earned Leave.

Half Pay Leave:
*Central Government: Both Central and State Government employees are entitled to 20 days of Half Pay Leave per year. However, for Central Government employees, 10 days are credited in advance to their leave account on January 1st and another 10 days on July 1st each year, in two installments.
*State Government: For our State Government employees, 20 days of Half Pay Leave are credited to their account only after completing one year of service from their date of joining. If the service is less than one full year, even by a single day, Half Pay Leave is not credited. In essence, a full year of service is required for eligibility.

Commuted Leave:
*Central Government: There is no limit on Commuted Leave for Central Government employees. They can avail up to half of the accumulated Half Pay Leave in their account as Commuted Leave throughout their entire service.
*State Government: For our State Government employees, Commuted Leave is limited to a total of 240 days during their entire service. They cannot utilize more than 240 days of Commuted Leave.

Leave Not Due:
*Central Government: Leave Not Due, for Central Government employees, is granted not exceeding 360 days in total throughout their service.
*State Government: For our State Government employees, Leave Not Due is limited to 180 days only.

Leave Not Due for Temporary Employees:
*Central Government: Temporary Central Government employees are also granted Leave Not Due, not exceeding 360 days, for treatment of certain specific illnesses.
*State Government: This facility is not available to employees of our State Government, especially temporary employees.

Facility to Convert Leave Type:
* Central Government: Central Government employees have the facility to convert a previously sanctioned type of leave into another type of leave.
* State Government: It’s not explicitly stated how much flexibility State Government employees have in this regard, but it might not be as readily available as under Central Government rules.

Maternity Leave in Surrogacy Cases:
* Central Government: In surrogacy cases, Central Government women employees who are commissioning mothers (and surrogate mothers, though it’s less likely to be relevant in this context) are granted 180 days of maternity leave.
* State Government: There are no specific provisions for maternity leave for State Government women employees in surrogacy cases. General maternity leave rules would apply, or this facility may not exist.

Paternity Leave in Surrogacy and Adoption Cases:
* Central Government: Central Government employees are granted Paternity Leave in cases of surrogacy and adoption of children.
* State Government: There are no specific provisions for Paternity Leave for State Government employees in cases of surrogacy and adoption, or this facility may not be available.

Child Adoption Leave:
* Central Government: Central Government employees are granted Child Adoption Leave of up to 150 days when adopting a child.
* State Government: There are no specific provisions for Child Adoption Leave for State Government employees, or this leave facility is not available.

Child Care Leave:
* Central Government: Central Government employees can avail Child Care Leave of 730 days during their entire service. However, this leave is not granted more than three times in a calendar year, and each spell of leave should not be less than five days.
* State Government: Child Care Leave for our State Government employees is limited to 90 days only. This leave can be availed in a maximum of 5 spells, with each spell not exceeding 15 days.

Special Leave for Sexual Harassment Cases:
* Central Government: Central Government employees are granted special leave of up to 90 days, under certain conditions, in cases related to sexual harassment at the workplace.
* State Government: This facility is not available to employees of our State Government. There is no provision for special leave related to sexual harassment.

The leave rules for Central Government employees appear to be significantly more favourable compared to those of the State Government. Leave rules related to employees are evolving with time and are designed to meet the needs of employees. We can also observe special types of leave granted in specific circumstances.
