Telangana High Court reserves verdict on blacklisting of injection

The TMSIDC has acted prematurely as it found the quality of only one batch of the drugs as substandard, says petitioner’s counsel

Hyderabad: The Telangana High Court on Thursday reserved its verdict on a petition challenging the three-year blacklisting of Ceftriaxone injection (1gm) by the Telangana Medical Services and Infrastructure Development Corporation Ltd (TMSIDC).

Justice Pulla Karthik was dealing with a writ plea filed by Sai Parenterals Limited. The petitioner’s counsel argued that the said blacklisting order was unjust and arbitrary as the tender conditions mandate the process of blacklisting only when the three separate batches of drugs fail the quality tests.

Since TMSIDC found the quality of only one batch of the drugs as substandard, the petitioner contended that the corporation has acted prematurely.

The counsel further told the court that the Drug Inspector did not provide the sample of substandard drug to the petitioner, which was necessary to file an appeal before the Central Drug Laboratory (CDL).

On the other side, the counsel for the authorities informed the court that their actions were based on regulatory compliance and that the drug test was conducted by a statutory authority and the same was declared as substandard making it unfit for supply.
