High Court not to decide child custody via habeas plea
Petitioner, accused in suicide of wife, files plea for 4-yr-old child
Hyderabad: A two-judge bench of the Telangana High Court on Tuesday refused to deal with the custody of a child in a habeas corpus petition. The bench of Justice Abhinand Kumar Shavili and Justice Pulla Karthik was dealing with a habeas corpus petition filed by a person from Warangal seeking production of his four-year-old child residing with his maternal grandparents. The petitioner’s spouse is alleged to have died by suicide and the petitioner was arrayed as the prime accused. The bench said that the welfare of the child was the most important aspect, and this would have to be adjudicated upon before the appropriate forum.
Parents in child custody case told to move civil court
A bench of Justice Abhinand Kumar Shavili and Justice Pulla Karthik of the Telangana High Court reiterated its stance in yet another battle for child custody. In this case, the mother of the child complained that her six-month-old infant was in the custody of her husband to her exclusion, and the same was illegal. The husband stated that the petitioner’s mental stability was in doubt and that she had made an earlier attempt to kill the infant. The bench said the parties must fight out their rival claims before the appropriate forum, namely the civil court.
HC issues notice SHRC appointments
A two-judge bench of the Telangana High Court comprising Chief Justice Ujjal Bhuyan and N. Tukaramji on Tuesday sought a response from the state government on not filling up the post of the State Human Rights Commission. The bench ordered notice in a PIL filed by practicing lawyer Adnan Mahmood. The petitioner pointed out that the office of the chairman and members of the commission had been lying vacant since December 2022; he also pointed out that there are over 5,245 cases pending before the commission. The bench made it clear that the petition would not bar the government from proceeding with filling up the posts.
HC takes up PIL on illegal buildings in Dhulapally
A bench of the Telangana High Court admitted petition on municipal inaction qua illegal construction and encroachments. Jammi Devendar in his PIL complained that there were largescale constructions at Dhulapally revenue village of Kompally municipality. He told the bench of Chief Justice Ujjal Bhuyan and N. Tukaramji that these constructions were continuing in spite of representations made to the authorities concerned.
HC to hear plea on minor minerals rules
A two-judge bench of Chief Justice Ujjal Bhuyan and N. Tukaramji of the Telangana High Court on Tuesday took on file a writ plea of the Federation of Minor Minerals Industry and others challenging the Telangana Minor Minerals Concession Rules. The amended rules permit the government to levy a fee to be paid by the leaseholder, and permit holder at the time of grant of the permit at the rate of 0.8 times the seigniorage fee for all minor minerals except colour granite, black granite and ordinary sand where the permit fee is 0.4 times the seigniorage fee. The government was given time till July 27 to file its counter.
